These Terms and Conditions (“Terms”) govern your access to and use of the Muz Fest website (www.muzfest.org), online ticketing platforms, digital communications, and any related services provided by Atuiqe LLC, doing business as Muz Fest (“Muz Fest,” “we,” “us,” or “our”).
By accessing or using any of our services (“Services”), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms, you must not access or use the Services.
Muz Fest reserves the right to revise, modify, or update these Terms at any time, in its sole discretion, without prior notice. Your continued use of the Services following the posting of any changes constitutes your acceptance of the revised Terms.
1. Eligibility
By accessing or utilizing any services, platforms, or offerings provided by Muz Fest (“Services”), you represent, warrant, and covenant that:
You are at least sixteen (16) years of age or the age of majority in your jurisdiction, whichever is greater;
You possess the full legal capacity and authority to enter into and be bound by these Terms; and
If acting on behalf of a company, organization, or other legal entity, you are duly authorized to bind such entity to these Terms, and all references to “you” or “your” herein shall refer to that entity.
Muz Fest reserves, at its sole and absolute discretion, the right to deny or revoke access to any individual or entity, without notice or liability, for any reason or no reason whatsoever.
2. Permitted Use of Services
You shall use the Services solely for lawful purposes and in compliance with all applicable federal, state, and local statutes, ordinances, and regulations. Without limitation, you shall not:
Use the Services to engage in, promote, or facilitate any unlawful, fraudulent, or deceptive activity;
Interfere with, disrupt, or compromise the integrity, functionality, or security of the Services or related systems;
Attempt to gain unauthorized access to any portion of the Services, servers, databases, or networks;
Upload, transmit, or disseminate any malicious code, viruses, spam, or harmful materials;
Impersonate any individual or entity, or misrepresent your affiliation therewith; or
Utilize automated means (including bots, scrapers, or spiders) to access, collect, or harvest data from the Services without the prior written consent of Muz Fest.
Any violation of the foregoing provisions shall constitute a material breach of these Terms and may result in immediate termination of access and potential civil and/or criminal liability.
3. Accounts and Security
Certain portions of the Services—such as vendor registration, volunteer enrollment, or ticket purchasing—may require account creation. You agree to:
Provide accurate, current, and complete registration information;
Maintain the confidentiality and security of your login credentials; and
Assume full responsibility for all activities undertaken through your account.
You must promptly notify Muz Fest at info@atuiqe.com of any unauthorized use, security breach, or suspected compromise of your account. Muz Fest expressly disclaims any liability for losses or damages resulting from your failure to safeguard your credentials.
4. Ticketing, Purchases, and Payments
4.1 Orders and Confirmation
All purchases, applications, or registrations are subject to acceptance by Muz Fest. Muz Fest reserves the right to refuse, cancel, or modify any transaction at its discretion, with or without notice.
4.2 Payments
Payments are processed via secure, third-party payment processors. By submitting payment information, you authorize Muz Fest and its payment partners to process and collect the full transaction amount, including applicable taxes and fees. Muz Fest does not retain full payment card information and shall not be responsible for third-party processor errors or breaches.
4.3 Refunds and Cancellations
All sales are final, except where expressly stated otherwise by Muz Fest. Refunds, credits, or exchanges may be issued solely at the discretion of Muz Fest, including in the event of event cancellation or verified service error. Requests for refund consideration must be submitted in writing to info@atuiqe.com within seven (7) business days following the relevant event or transaction.
5. Intellectual Property Rights
All materials contained within or accessible through the Services—including but not limited to text, images, graphics, logos, videos, audio, event content, and overall design—are the exclusive property of Muz Fest or its licensors and are protected under applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for personal, non-commercial use. You may not:
Reproduce, distribute, modify, publicly perform, or display any content without express written consent;
Use Muz Fest trademarks, trade names, or logos without prior authorization; or
Frame, mirror, or scrape any portion of the Services for commercial exploitation.
Unauthorized use constitutes infringement and may subject you to civil penalties, injunctive relief, and/or criminal prosecution.
6. Media and Recordings
By entering or participating in any Muz Fest event or affiliated program, you irrevocably grant Muz Fest a perpetual, worldwide, royalty-free license to capture, reproduce, and distribute your image, likeness, voice, or performance for promotional, archival, and educational purposes, in any medium, without further notice or compensation, unless prohibited by law.
7. Third-Party Links and Services
The Services may include hyperlinks or integrations with third-party platforms not owned or controlled by Muz Fest. Muz Fest disclaims any responsibility for the availability, content, or privacy practices of such third parties. Access to external sites is undertaken solely at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, Muz Fest, its affiliates, officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, exemplary, or punitive damages—including but not limited to loss of profits, data, or goodwill—arising out of or related to:
Use or inability to use the Services;
Attendance at or participation in any Muz Fest event;
Unauthorized access to or alteration of your data; or
Any other matter related to the Services.
In no event shall Muz Fest’s aggregate liability exceed the amount paid by you, if any, for the specific Service giving rise to such claim.
9. Disclaimer of Warranties
The Services are provided strictly on an “as is” and “as available” basis. Muz Fest makes no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Muz Fest does not warrant that the Services will be uninterrupted, error-free, or secure, nor that any content is accurate or current.
All risk associated with use of the Services rests solely with you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Muz Fest, its affiliates, officers, agents, employees, contractors, and representatives from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use or misuse of the Services;
Your breach of these Terms; or
Your violation of any law or third-party rights.
This indemnification obligation shall survive the termination or expiration of these Terms.
11. Termination
Muz Fest reserves the absolute right, without prior notice or liability, to suspend, restrict, or terminate your access to any part of the Services for any breach of these Terms, violation of applicable law, or conduct deemed detrimental to Muz Fest’s interests or reputation. Upon termination, all rights granted herein shall immediately cease.
12. Governing Law and Jurisdiction
These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington, and waive any objection based on venue or forum non conveniens.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with Muz Fest’s Privacy Policy and any other incorporated policies, constitute the entire and exclusive agreement between you and Muz Fest with respect to the Services and supersede all prior or contemporaneous communications, proposals, or understandings, whether oral or written.
