OVERVIEW

These Terms of Use (“Terms”) govern your access to and use of Muz Fest’s website (www.muzfest.org), event listings, ticketing pages, communications, and related services (collectively, the “Services”), and your purchase, possession, transfer, acceptance, resale, or use of tickets, wristbands, credentials, products, experiences, add-ons, and services offered by or on behalf of Atuiqe LLC & Muz Fest (“Muz Fest,” “Atuiqe,” “we,” “us,” or “our”) in connection with any Muz Fest event, activation, or related experience (each, an “Event”).

These Terms incorporate by reference additional policies, rules, and disclosures that may apply depending on the Event and Services used (collectively, “Other Policies”), including without limitation: purchase policies, transfer policies, resale rules, venue/house rules, safety and security policies, accessibility procedures, code of conduct, prohibited items lists, age policies, alcohol policies, media/recording rules, and any Event-specific rules communicated on the Event page, during checkout, in ticket confirmations, or onsite signage/announcements.

If these Terms conflict with any Other Policies, the Other Policies govern only for that conflict, except that Sections 12–14 (Governing Law; Exclusive King County Venue; Arbitration/Class Action Waiver) control to the fullest extent permitted by law.

NOTICE REGARDING ARBITRATION AND CLASS ACTION WAIVER

These Terms include a mandatory individual arbitration agreement and a class action waiver in Section 14. You and we agree that most disputes must be resolved by binding arbitration rather than in court. By agreeing to arbitration, you and we each waive the right to a jury trial and the right to participate in a class action.

NOTICE REGARDING SEATTLE / KING COUNTY VENUE

If arbitration does not apply or is held unenforceable for a particular claim, you agree that any lawsuit or court proceeding may be brought only in King County, Washington (Seattle area), as described in Section 13.

NOTICE REGARDING FUTURE CHANGES

We may revise these Terms at any time. The “Last Updated Date” reflects the most recent revision. Your continued use of the Services or purchase/use of Tickets after updates become effective constitutes acceptance of the updated Terms for that use/purchase.

1. ELIGIBILITY

By accessing or using the Services, you represent and warrant that:
(a) you are at least sixteen (16) years of age (or the age of majority in your jurisdiction, if higher);
(b) you have the legal capacity to enter into these Terms; and
(c) if you are acting on behalf of a company or organization, you have authority to bind that entity, and “you” includes that entity.

We reserve the right, in our sole discretion and without liability, to refuse service, cancel transactions, deny entry, revoke credentials, or restrict access to the Services or Events at any time, with or without notice, where permitted by law.

2. PERMITTED USE OF SERVICES

You may use the Services only for lawful purposes and in compliance with all applicable laws and regulations. Without limitation, you may not:

  • use the Services to engage in or facilitate unlawful, fraudulent, deceptive, or abusive conduct;

  • interfere with, disrupt, compromise, overload, or impair the Services or related systems;

  • attempt unauthorized access to any portion of the Services, servers, accounts, databases, or networks;

  • upload or transmit malware, spyware, viruses, or harmful code;

  • harvest data, scrape, crawl, or use bots/automation without prior written consent;

  • impersonate any person or entity or misrepresent affiliation; or

  • use the Services in a way that violates any ticketing rules, access rules, purchase limits, or security controls.

We may investigate violations and may take any action we deem appropriate, including suspension/termination, cancellation/voiding of tickets, and referral to law enforcement where warranted.

3. ACCOUNTS AND SECURITY

Certain Services may require accounts through third-party ticketing platforms or tools. You agree to:

  • provide accurate, current, and complete information;

  • keep credentials secure and not share access; and

  • remain responsible for all activity conducted through your account, whether or not authorized by you.

Notify us at info@atuiqe.com if you believe your account has been compromised. To the fullest extent permitted by law, we are not liable for losses resulting from compromised credentials, shared devices, or unauthorized account access.

4. TICKETING, PURCHASES, AND PAYMENTS

4.1 Orders; Acceptance; Right to Refuse

All purchases, registrations, and applications are subject to acceptance. We may refuse, cancel, modify, or limit any transaction in our sole discretion, including for suspected fraud, policy abuse, purchase-limit circumvention, suspected unauthorized resale, or operational necessity.

4.2 Payment Processing

Payments are processed through third-party payment processors and ticketing platforms. By submitting payment information, you authorize processing of the full amount, including taxes and fees. We do not store full card numbers and are not responsible for third-party processor errors, outages, or security incidents.

4.3 ALL SALES FINAL; Refunds; Credits; Exchanges

ALL SALES ARE FINAL unless otherwise stated in writing for the specific Event or required by law. Tickets and fees are generally non-refundable and non-exchangeable, including if you cannot attend, arrive late, leave early, are denied entry for policy violations, or are removed for misconduct.

If an Event is canceled or materially rescheduled, any refund remedy (if offered) may be limited to the base ticket price paid, excluding fees, unless a greater remedy is required by law. We are not responsible for travel, lodging, meals, rideshare, parking, lost wages, or other incidental expenses.

Refund requests (if allowed) must be submitted to info@atuiqe.com with proof of purchase and order details within seven (7) business days of the Event or transaction at issue (unless a different window is required by law or stated in an Event-specific policy).

5. INTELLECTUAL PROPERTY RIGHTS

All content and materials on or through the Services—including text, graphics, logos, photos, video, audio, event content, and design—are owned by Muz Fest/Atuiqe or our licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access the Services for personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, perform, scrape, frame, mirror, or otherwise exploit any content without prior written consent.

6. MEDIA AND RECORDINGS (PHOTOGRAPHY/VIDEO RELEASE)

By entering or attending an Event, you grant Muz Fest/Atuiqe and our designees a perpetual, worldwide, royalty-free right to photograph, record, and capture your image/likeness/voice and to use such materials for promotional, marketing, sponsorship fulfillment, editorial, and archival purposes in any media, without compensation, unless prohibited by law.

No-Photo/No-Video Zones or Events: Certain areas or performances may prohibit photography or recording. If so, rules will be communicated via signage, announcements, ticket instructions, or staff directions. You agree to comply. Violation may result in removal without refund and/or credential revocation.

7. THIRD-PARTY LINKS AND SERVICES

The Services may link to or integrate with third-party platforms. We do not control those third parties and disclaim responsibility for their content, availability, security, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.

8. DISCLAIMER OF WARRANTIES

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components, or that content will be accurate or current.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Muz Fest/Atuiqe and our affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or enjoyment, arising out of or relating to the Services or any Event.

If liability cannot be excluded, our total cumulative liability will not exceed the greater of (a) $100 or (b) the amount you paid for the specific Service/Ticket giving rise to the claim, except where a higher amount is required by law.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Muz Fest/Atuiqe and our affiliates, officers, employees, contractors, agents, partners, and representatives from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
(a) your use or misuse of the Services;
(b) your violation of these Terms or Event rules;
(c) your violation of law; or
(d) your infringement of third-party rights.

This obligation survives termination.

11. TERMINATION

We may suspend or terminate access to the Services, cancel orders, void tickets, and/or deny entry to Events for any breach of these Terms, violation of law, suspected fraud, safety/security concerns, or conduct we deem harmful to the Event experience or our operations, to the fullest extent permitted by law.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Washington, without regard to conflict of law rules, except that the Federal Arbitration Act governs the arbitration provisions in Section 14.

13. EXCLUSIVE VENUE — KING COUNTY, WASHINGTON

If arbitration does not apply or is held unenforceable for a particular claim, you agree that any court proceeding must be brought exclusively in King County, Washington, and you consent to jurisdiction and venue there and waive objections based on forum non conveniens.

14. DISPUTES; ARBITRATION; CLASS ACTION WAIVER

PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

14.1 Informal Resolution First

Before initiating arbitration or court, you agree to contact us at info@atuiqe.com with your name, order details, the Event name/date, a description of the dispute, and the relief requested. We will attempt good-faith resolution.

14.2 Mandatory Individual Arbitration

Except for eligible small claims matters, any dispute arising out of or relating to these Terms, the Services, Tickets, or Events will be resolved by binding individual arbitration, not in court.

14.3 Class Action Waiver

You and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding.

14.4 Small Claims

Eligible small claims matters must be brought only on an individual basis in King County, Washington, unless applicable law requires otherwise.
